Let us begin our discussion of a constitution. A few things we need to work out...
Are we sticking with the "Corporative Chamber" or are we naming our assembly something different?
How shall the delegate to the Senate be known within the province?
How shall the Cunstuval be known within the province?

Are we sticking with the "Corporative Chamber" or are we naming our assembly something different? Perhaps this is just me, but I see no reason to change the name of the assembly. It's not like the name causes any problems. Change for the sake of betterment is improvement, change for the sake of change is anarchy. How shall the delegate to the Senate be known within the province? Senator? How shall the Cunstuval be known within the province? Maestro works fine for me, but if the people want change, I'll jump on the bandwagon.

Maestro is what we call the Premier, if we call the Cunstuval "Maestro" I imagine we will confuse everyone.

I am not proposing anything in particular here...I just threw this together to give us something to build on..
CONSITUTION OF THE SOVEREIGN PROVINCE OF BENITO
We, the people of Benito, do hereby endorse this constitution for the government of our great Province and do therefore ordain it to be the rule and guide of our government and the guardian of our rights.
The State
Art. 1. The Sovereign Province of Benito is an autonomous and self-governing member of the federal Talossan nation and pledges eternal allegiance to His Royal Majesty, and the Regipäts Talossan.
Art. 2. The name of the state is la Provinçù Soveran da Benito. In English, it is the Sovereign Province of Benito.
Art. 3. The sacred and irremovable territory of the Sovereign Province of Benito shall consist of the cantons of Lorentizio and Riverside.
Art. 4. The capital of the Province is Lorentizio.
Art. 5. The sole historic and national language of the entire Talossan people, and therefore of the Beniton Province, is the Talossan language (el glhetg Talossan). The Beniton government shall also recognise English as a useful working second language, and may adopt tertiary working languages by law.
Art. 6. The Provincial flag shall be registered with the College of Arms with the blazon, We fess vert and gules an inescutcheon per tierce vert, argent, and gules fimbriated or in chief a royal crown proper. The Corporative Chamber
Art 7. Legislative power in the Sovereign Province of Benito is invested in a Corporative Chamber. The Corporative Chamber shall consist of representatives of political parties granted legislative seats in a general election.
Art 8. The Corporative Chamber shall have power to pass any bill into law by a simple majority vote of its members. Voting sessions shall open at the first hour of the first day of each month except during national General Elections. At the dissolution of the Cosa, the Corporative Chamber will also be dissolved. Seats in the Corporative Chamber will be redistributed according to the ballots cast in the General Election by citizens of the Province.
The Maestro
Art 9. The Maestro shall be the majority leader in the Corporative Chamber. He shall have the power to issue proclamations which have the force of law. These proclamations may be appealed or amended as regular laws.
Art 10. A new Maestro may be chosen at any time by a resolution approved by a majority of the Corporative Chamber, but a resolution electing a new Maestro or continuing the current Maestro in office must be approved by the Corporative Chamber at least once in every term of the national Cosa. The first order of business of each newly assembled Corporative Chamber will be to elect a new Maestro from among its members.
Il Viceré
Art 11. The Viceré, or Viceroy is the representative of the King of Talossa, and as such, shall have veto power over all laws of the Corporative Chamber. The Viceré is appointed by the King pursuant to Organic Law. While the King may freely appoint a Viceré, it is the preference of the citizens of the Province of Benito that the Viceré be a citizen of the Province for at least one year prior to appointment.
El Noval Representanteu
Art 12. Benito’s delegate to the Senäts shall be known within the Province as el Noval Representanteu and styled “Senator.” The Noval Representanteu shall be selected pursuant to Organic Law.
Distribution of Power
Art 13. So that no conflict of interest may occur, or that no one individual may take over the province in a hostile attempt, no-one may hold more than one of the offices of Maestro, Viceré, or Noval Representanteu simultaneously. Justice
Art 14. The Cort pü Inalt shall have original jurisdiction to try all cases arising under Beniton law.
Art 15. When possible, the Province of Benito reserves the right to appoint a Provincial Attorney General or "PAG." The PAG shall be a member in good standing of the Royal Talossan Bar and a citizen of Benito for at least 6 months, and shall serve as counsel for the Province in all matters, criminal and civil. The PAG shall be appointed by the Corporative Chamber at the recommendation of the Maestro and shall serve for life, vacating office only upon resignation, death, mental incapacitation, resignation or dismissal from the Talossan Bar, moving to another province, removal from office by a 2/3 majority vote of the Corporative Chamber and the approval of the Viceroy or felony conviction by the Cort pü Inalt. Any person holding the offices of Maestro or Viceroy who is appointed to this position, will be required to resign prior to assuming the office of Provincial Attorney General. Amendments
Art 16. This Constitution may be altered by a Corporative Chamber resolution, which must be approved by a referendum of the people attaining the favour of three-fifths of those who vote and promulgated by the Viceré.

I just checked the translator and it showed up as no result. It does not look like it is conjugated for singular feminine form, which is why I am asking. Art. 3. This section raises two important points- what is our official demonym? Beniton, Benitonian, what? Also, I move that we recognize Italian (for cultural purposes) as well as German (due to the high population of German speakers in the province) as Recognized minority languages. Art 8. Each member shall have a prescribed amount of time in which to cast his vote before voting closes. Why don't we mimick the happenings of the national Clarks and follow that policy? We could offset it by a week or two in order to allow our MCCs and MCs ample time to vote in both assemblies. The Viceroy Art 11. The truth comes out, I stole it from the Constitution of Maricopa I like that idea. The former issue is very important. Let me just say that the constitution is purposely vague leaving only English and Talossan as languages. I think making German and Italian minority languages is a great idea, but I think we should do it by way of legislation rather than putting it in the constitution, just my opinion. We need to resolve the gentilic situation, as you have mentioned. I think Beniton (pronounced Beh-NEE-tun) is the simplest option and sounds all proper and such. But I'm trying to avoid turning this into a Delawarian vs. Delawarite debate. I was thinking we simplify it further. What if we open the session from the first day of each month to midnight of the 7th day. General Elections coincide with National General Elections. The Viceroy Art 11. The Viceroy......... This is the Cunstaval, correct? This is. I chose for this draft to style the Cunstuval "Viceroy" simply because the literal definition of Viceroy is "a royal official who governs a country or province in the name of and as representative of the monarch." I also think that using the Italian form "Viceré" sounds really cool. I appreciate the feedback. Again, I am just throwing some ideas out there to get the ball rolling, so by all means, I want people to add/subtract and amend.

The constitution should outline the laws, which will be somewhat more static than the composition of the province. While there is a large population of German speakers in the province, and Italian reflects our cultural heritage, these facts could be subject to change. Hell, 10 years from now we could have a Rumanian revolution, rename the province Wallachia, and be a bunch of Mongolian speakers. Perhaps the issue of language is best left as a "de facto" issue. We need to resolve the gentilic situation, as you have mentioned. I think Beniton (pronounced Beh-NEE-tun) is the simplest option and sounds all proper and such. I like Beniton, but... just throwing this out here, why not Benitian (ben-NEE-shin)? In my opinion at least, it rolls of the tongue better, and pays a homage to the concept of Italian demonyms (i.e. Venice = Venetian) I also think that using the Italian form "Viceré" sounds really cool. Amen to that.

I am thinking of replacing the bit about the Provincial Attorney General, anyone have anything they feel should be there instead? I just think the PAG concept would best be accomplished through legislation. Possibly a providential judges council of say 3 or 5 judges?

Then I'd say it opens the door for us to one day have a provincial court if we ever have enough citizens, as well as the post of PAG and whatever else we can think up. Right now, none of those things are practical, because we have few active citizens and no lawyers.
But if the High Cort works out a way to admit people to the bar, we may end up with a bunch more lawyers (nooooo!) and obviously, more active citizens is always a goal of ours.

What if we say "The people of Benito reserve the right to establish and maintain a provincial justice system to meet the ever changing needs of the Province pursuant to Organic Law and under the direction of the Cort pü Inalt?" Then I'd say it opens the door for us to one day have a provincial court if we ever have enough citizens, as well as the post of PAG and whatever else we can think up. Right now, none of those things are practical, because we have few active citizens and no lawyers. But if the High Cort works out a way to admit people to the bar, we may end up with a bunch more lawyers (nooooo!) and obviously, more active citizens is always a goal of ours. That works too. ;D
