The Joseph McCarthy Amendment

WHEREAS, expulsion from the Greatest (albeit unrecognized) Country on Earth is the highest form of punishment our judicial system can levy, and

WHEREAS, as such, imposing such a penalty should not be taken lightly, and

WHEREAS, currently, Organic Law permits the Uppermost Cort to impose the penalty upon citizens it convicts of "anti-Talossan activities", and

WHEREAS, it obviously fails to define what exactly "anti-Talossan activities" are, and

WHEREAS, this sounds very similar to the (US) House Un-American Activities Committee to me, and

WHEREAS, we don't need McCarthyism in Talossa, so

THEREFORE, the Ziu hereby resolves to put forward the following amendment to the Citizenry for ratification:

Article XVII, Section 5 of Organic Law which currently reads:

If the Uppermost Cort shall at any subsequent time find any fraud or dishonesty in a Citizen's original application for citizenship, including his statements to the Cort or to Cosâ members; or if the Uppermost Cort shall convict the Citizen for anti-Talossan activities, it may impose the penalty of expulsion from Talossa. The King may commute such a sentence.

shall be amended to read:

If the Uppermost Cort shall at any subsequent time find any fraud or dishonesty in a Citizen's original application for citizenship, including his statements to the Cort or to Cosâ members, it may impose the penalty of expulsion from Talossa. The King may commute such a sentence.

Before anybody comments below, yes, I'm aware Senator McCarthy wasn't on the HUAC. Also, I'm open to taking this section out completely, since Article XVI Section 12 already allows the UC to impose the "penalty of expulsion" upon a unanimous vote in any extreme circumstance.

Historically, this meant being friends with other micronationalists out there that Ben disliked. That was interpreted as succouring the enemy and thus anti-Talossan. It never meant un-Talossan, as in behaving improperly within Talossa. Nevertheless, yes, please let's get rid of this phrasing! Thumbs up.

I'm ambivalent. On the one hand, I like the general thrust of this bill. But maybe it would be better to just strictly define the term, instead? Hm... I'm not sure.

The entire section itself isn't completely necessary, since the UC can impose expulsion in any "extreme" circumstance upon a unanimous vote, per Org.XVI.12. Anything that would actually warrant expulsion would be covered under the extreme circumstance section, I would think. Though it might be good to define what would qualify as an extreme circumstance, perhaps in another bill or when the standing committee comes to Article XVI.

Given that OrgLaw XVI:12 still allows the Ziu, as you point out, to enact properly-defined crimes punishable by loss if Talossan citizenship, I think this is a great amendment. I'll do it.
