Since we adopted our Constitution there have been four instances of irregularities in the allocation of seats within the House of Commons. The irregularities, so far, seem to come in one of two forms. Either seats are left vacant from rounding down, or a party's allocation that should round up is rounded down in order to not exceed the current 20 seat limit (10% of the Cosa).
I here by submit the following referendum to amend the Constitution of the Supreme Province of Atatürk.
Article II, Section 1 currently reads:
ARTICLE II.
Section 1:
Provincial lawmaking powers will be vested in the Atatürk House of Commons. The number of seats in the House of Common shall equal 10% of the number of seats in the Cosa. The allocation of the seats amongst political parties will correspond to the percentage of provincial votes each registered party received in the most recent General Election, rounded to the nearest whole number, to be assigned by party leaders, in accordance with Article VI of the Organic Law.
In order to flesh out the process and provide a fair system to allocate seats, Section 1 is amended and the following Sub-Sections are added:
Section 1:
Provincial lawmaking powers will be vested in the Atatürk House of Commons. The number of seats in the House of Common shall equal 10% of the number of seats in the Cosa. The allocation of the seats amongst political parties will correspond to the percentage of provincial votes each registered party received in the most recent General Election, rounded to the nearest whole number no less than one, to be assigned by party leaders, in accordance with Article VI of the Organic Law.
Sub-Section 1.1: The following procedures shall be applied in the order listed to assign seats in the event that the allocation of seats using standard rounding results in one or more seats being vacant.
a. Vacant seats shall be equally divided between the registered parties as long as the seats divide into whole numbers.
b. If a single seat is vacant, each party who desires to compete for the seat shall pick a number between 1 and 26 and post their choice in Witt within two weeks of notification. The Power Ball lottery drawing held the Saturday following the two week notification and posting period will be used to determine the winner of the seat. Whichever party’s number is closer to the Power Ball number wins the seat. In the event of a tie, the two parties’ previously chosen numbers shall remain the same and be compared to the Power Ball number from the drawing on the following Wednesday. This process may only award one seat at a time and parties are not obligated to compete.
c. In the event that multiple seats are available, each party desiring to complete shall each pick as many numbers between 1 and 26 as there are seats available and post their choices in Witt within two weeks of notification. The Power Ball lottery drawing held the Saturday following the two week notification and posting period will be used to determine the winner of the seat. For each seat’s contest, the Power Ball number will be compared to each party’s number in the order the number is posted. In the event of a tie during any of the contests, the two parties’ previously chosen numbers shall remain the same and be compared to the Power Ball number from the drawing on the following Wednesday. Parties are not obligated to compete.
Sub-Section 1.2: The following procedure shall be applied in order to assign seats in the event that allocation of seats using standard rounding results in a number of seats greater than the number permitted by Article II Section 1 of this constitution.
a. Each party eligible to round up to the next whole number shall be rounded down to their current whole number.
b. The parties forced to round down may then compete for the available seats in accordance with the procedures outlined above in Article II Section 1 Sub-Section 1.1.c. Only those parties forced to round down by Article II Sub-Section 1.2.a may compete and parties are not obligated to compete.
